TERMS & CONDITIONS (T&C)
www.sankatmochantherapy.com or engaging our therapists, you electronically agree to be legally bound by these terms.
SECTION 1: INTRODUCTION & DIGITAL AGREEMENT
- 1.1 Binding Nature: These Terms and Conditions constitute a legally binding electronic agreement between you (the "Patient", "User", or "Guardian") and Sankatmochan Home Therapy (the "Company").
- 1.2 Digital Acceptance: Under the Information Technology Act, 2000, checking the "I Agree" box during booking, submitting a digital consent form, or making an online payment holds the same legal validity as a physical signature on paper.
SECTION 2: SERVICES PROVIDED
Sankatmochan Home Therapy acts as an advanced healthcare service provider specializing in In-Home therapies. Our services include, but are not limited to:
- Physiotherapy (Orthopedic, Neurological, Spine, and Sports Rehab).
- Child Development & Pediatric Therapy (Autism, ADHD, Cerebral Palsy).
- Speech and Behavioral Therapy.
- Post-Surgical Rehabilitation and Tele-Consultations.
SECTION 3: BOOKING, CANCELLATION & RESCHEDULING POLICY
3.1 Appointment Booking
All appointments must be scheduled exclusively through our official website or authorized WhatsApp business numbers. Time slot allocations are subject to therapist availability and travel logistics.
3.2 Cancellation by Patient
Patients must provide at least 4 hours prior notice to cancel or reschedule a home visit. If the patient cancels after the therapist has been dispatched or reaches the location, a Visit/Travel Fee will be strictly enforced and deducted from the patient's package.
3.3 Service Refusal by Company
The Company reserves the right to cancel an appointment or refuse service if the patient's location is deemed unsafe, outside serviceable limits, or if there is a history of inappropriate behavior towards our staff.
SECTION 4: FINANCIAL TERMS & 100% NO-CASH POLICY
- 4.1 Cashless Ecosystem: Sankatmochan Home Therapy operates on a strictly 100% digital payment model. Patients are strictly prohibited from handing over cash or making direct UPI transfers to the visiting therapist's personal account.
- 4.2 Valid Payments: All payments must be routed through the Company's official website, authorized payment links, or the Company's official QR Code.
- 4.3 Advance Payments: Therapy sessions and monthly packages require advance payment to secure the booking. Packages are valid for 30 days from the date of purchase. Unused sessions beyond this validity period will automatically lapse.
- 4.4 Refund Policy: Once clinical therapy has commenced, fees paid for the session or package are Non-Refundable. Refunds are only processed if the Company is permanently unable to provide the promised service due to therapist unavailability.
SECTION 5: HOME VISIT SAFETY & PROTOCOLS
To ensure a safe environment for both the patient and our healthcare professionals, the following protocols are mandatory:
- 5.1 Safe Environment: The patient/family must provide a clean, well-lit, and secure environment for the therapy session.
- 5.2 Guardian Presence: For all pediatric (child) patients and female patients, the continuous physical presence of a responsible adult/guardian in the same room is mandatory during the entire therapy session.
- 5.3 Pet Policy: For the safety of our therapists, all pets (dogs, cats, etc.) must be secured in a separate room for the duration of the home visit.
- 5.4 Zero Tolerance: Any form of verbal abuse, harassment, or inappropriate conduct toward our therapists will result in immediate termination of services, forfeiture of all paid fees, and legal action.
SECTION 6: MEDICAL DISCLAIMER & LIMITATION OF LIABILITY
- 6.1 Not For Emergencies: Our home therapy services are strictly for rehabilitation and management. They are NOT a substitute for emergency medical care. In case of a medical emergency (e.g., cardiac arrest, severe breathing issues), immediately visit the nearest hospital.
- 6.2 No Guarantee of Cure: Rehabilitation is a gradual process depending on patient age, condition severity, and compliance with exercises. The Company provides expert care but does not guarantee 100% recovery or a specific timeline for healing.
- 6.3 Accurate Medical Disclosure: The patient is legally responsible for disclosing their complete and accurate medical history (including pacemakers, metal implants, allergies, prior surgeries). The Company shall not be held liable for any adverse reactions or injuries resulting from concealed medical information.
SECTION 7: INTELLECTUAL PROPERTY RIGHTS
All content, logos, digital forms, treatment protocols, text, and graphics present on the Sankatmochan Home Therapy website are the exclusive intellectual property of the Company. Unauthorized reproduction, distribution, or commercial use of our digital assets is strictly prohibited and subject to copyright infringement laws.
SECTION 8: FORCE MAJEURE
The Company shall not be held liable for any delay or failure in performance of services resulting directly or indirectly from acts of nature, severe weather conditions, pandemics, government lockdowns, or any other circumstances beyond our reasonable control.
SECTION 9: GOVERNING LAW & DISPUTE RESOLUTION
- 9.1 Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
- 9.2 Dispute Resolution: Any disputes, claims, or legal proceedings arising out of or relating to these Terms or the services provided shall be subject to the exclusive jurisdiction of the competent courts located in Bharatpur, Rajasthan, India.
SECTION 10: MODIFICATION OF TERMS
The Company reserves the right to update, modify, or replace these Terms and Conditions at any time without prior individual notice. The most current version will always be posted on our digital portal. Continued use of our services following any changes constitutes acceptance of those changes.
